If the original kit hasn't been offered in the past three years or the Trade Mark kept in use there is nothing you can do about it. At least that is what I've been told and why rocket companies are allowed to recreate older Centuri and Estes kits and sale them.

Trying to understand
Hi Jay,
Not trying to start trouble, but trying to understand...what exactly is the beef with this sale? Is the expectation that if it is your design, you get royalties for every "Tau Zero" unit sold, whether 1:1, upscale or downscale? Would you have been fine if they simply asked permission to build an upscale of the design? Again, not trying to poke a sore wound, but am curious what your expectation is? I don't know squat about the seller, but if I had to guess, I'd guess that the seller liked your design (a good thing IMO) , asked Semroc or equivalent if they could upscale it for them , and did so. If the seller's "build pile" is as large as mine is, maybe they're deciding to pass it on to another rocketeer that also enjoys an upscale of your design (another good thing IMO). I could be wrong, but I'm thinking the seller is looking to sell a "one off", not reproduce this kit exponentially, in which case I'd certainly expect them to contact you first. I have a design or two that were produced by a now OOP kit manufacturer. I'd be moderately flattered if someone decided to clone it, up or downscale it. Most certainly, I wouldn't expect individuals to contact me if they decided to reproduce it in any scale. Upscales are done to many, many designs in rocketry. I'm fairly certain that the designers are not contacted every time a design is used...not saying it is right or wrong, just saying. Honestly just curious if your expectations are consistent with (rocket) industry expectations. -Eric- |

My Estes clone kit sales are glacially slow, but I always give credit to the original company and encourage buyers to also buy the original when/as available. Also I do not include decals so do not run up against copyright issues.
I think the upscale and regular scale markets are essentially mutually exclusive. I for one would love to see Estes make an upscale BT-70 Goblin and Patriot to accept the new 29mm motors and convert to 24mm as well. There is some possibility of the industry agreeing on a "best practices" plan including royalties for off-scale uses of some company's designs. Sort of like FRAND licensing in patents. There was a post on YORF or TRF warning about a vendor (it could have been this guy) doing upscales. I can't find the original post. This "vendor" would post face cards but no pictures of the finished models. The picture of parts show a black and white copy of the Semroc instructions. I'm sorry to see this. Some people have no respect for the original designer or idea. I have nothing against somebody doing a single upscale or downscale. If they go into production and make money off your work it's another story. In entertainment, I've been ripped off many times over the years. These are the same people who say: "You didn't come up with that. There's nothing new under the sun!" They are always so surprised when I show them the Copyright forms. Years ago I took some comedy workshop classes in L.A. Our instructor talked about ownership of original material, He said: "It takes talent to create, it just takes nerve to steal." If somebody were to copy my Odd'l Rockets instructions like this . . . I've got too many hours of time and money invested just to give it away.

In fact, our own Craig "BARCLONE" McGraw created several different RockSim designs based on that nose cone. If this seller had asked first, I would have considered letting him do this. But he didn't, and he wants to make money without asking permission. Then there's also the point that Semroc released this design as a kit, and most of the money should go to Sheryl and Bruce McLawhorn.
